1. Data Security and Assumption of Risk
Second Summit Digital LLC ("Provider") employs industry-standard administrative, physical, and technical safeguards to protect data. However, no digital architecture, server, or transmission is completely secure against unauthorized access. Clients assume full responsibility and liability for the security, storage, transmission, and lawful processing of all constituent, voter, donor, customer, and personal data managed through our infrastructure.
2. Client Compliance Warranties
Clients using our systems represent and warrant that they have obtained all legally required rights, consents, explicit opt-ins, and privacy notifications before providing personal data or deploying digital campaigns. Clients guarantee that their data collection and processing activities comply with all federal, state, and international privacy laws, including TCPA, CAN-SPAM, CCPA/CPRA, and state consumer privacy laws.
3. Confidentiality & Non-Disclosure
We protect and hold in strict confidence all non-public, proprietary information, internal campaign strategies, opposition research, customer/voter lists, software source code, technical specifications, and financial details disclosed to us by our Clients. These confidentiality obligations survive the termination of any agreement for a period of three (3) years, while trade secrets and proprietary code remain confidential indefinitely.
4. Public Attribution
Unless a Client expressly requests stealth status in writing prior to project execution, Provider reserves the right to list the Client's name, logo, and a general high-level summary of non-confidential services provided in Provider's portfolio and marketing materials.
5. Mandatory Legal Process
In the event Provider is served with a subpoena, civil investigative demand, search warrant, or legal process issued by a government agency, congressional committee, election commission, or court arising out of Client's political campaign, business activities, or digital architecture, we will comply with lawful requests. Clients are responsible for fully reimbursing Provider for all expenses incurred in responding to such demands, including external legal fees and administrative costs.
